Summit Mind Psychiatry, PLLC (“Summit Mind Psychiatry,” “we,” “our,” or “us”) respects the privacy of information relating to your health.
This Washington Consumer Health Data Privacy Policy describes our practices regarding “consumer health data” as defined by the Washington My Health My Data Act (“MHMDA”), Chapter 19.373 RCW.
This policy explains the consumer health data we may collect through our public website, why we collect it, the sources from which it may be collected, how it may be used or shared, and the rights available to Washington consumers.
1. Scope of This Policy
This policy applies to consumer health data subject to the Washington My Health My Data Act. Under Washington law, consumer health data generally includes personal information that is linked or reasonably linkable to a consumer and identifies the consumer's past, present, or future physical or mental health status. Depending on the circumstances, this can include information identifying a consumer as
seeking healthcare services.
Not all health-related information maintained by Summit Mind Psychiatry is governed by the MHMDA. Protected Health Information (“PHI”) governed by the Health Insurance Portability and Accountability Act (“HIPAA”), certain healthcare information collected, used, or disclosed in accordance with Chapter 70.02 RCW, and certain other healthcare information are exempt from the MHMDA.
Patient medical and psychiatric records maintained by Summit Mind Psychiatry through its electronic health record (“EHR”) system are handled in accordance with applicable healthcare privacy laws and are not treated as ordinary public-website analytics information.
Our practices concerning PHI and patient healthcare records are described separately in our Notice of Privacy Practices.
Our practices concerning general information collected through our public website are described in our Privacy Policy.
12. Categories of Consumer Health Data We May Collect
Depending on how you interact with our public website, we may collect information that qualifies as consumer health data under Washington law, including:
Healthcare-interest information
Information that may indicate that a visitor is seeking or considering psychiatric, mental-health, telehealth, medication-management, or related healthcare services.
Website interaction information
Information about pages viewed and interactions with healthcare-related website content when that information is linked or reasonably linkable to a consumer and identifies or could reveal that the consumer is seeking healthcare services.
Technical and device information
Information such as IP address, browser type, device information, approximate geographic location, referring source, and similar technical information when it qualifies as consumer health data under Washington law.
Information voluntarily provided through the public website
Information you choose to submit through general website contact or inquiry features, if available.
We encourage visitors not to submit detailed medical, psychiatric, medication, diagnostic, or other sensitive clinical information through general public website forms.
Patient intake forms, clinical questionnaires, medical histories, and other detailed patient healthcare information are completed through designated healthcare systems rather than through the public Summit Mind Psychiatry website.
3. Information Collected Through the Patient Portal and EHR
Summit Mind Psychiatry uses a separate electronic health record and patient portal environment for patient healthcare information.
Links on our website may redirect patients to an externally hosted patient portal, intake system, scheduling system, or other healthcare platform.
When you select one of these links, you may leave the Summit Mind Psychiatry public website. Information you subsequently enter into the patient portal or EHR environment—such as medical history, psychiatric history, medications, diagnoses, symptoms, clinical questionnaires, treatment information, or communications with the practice—is maintained within the applicable healthcare environment.
Such information may constitute PHI or other healthcare information governed by HIPAA, Chapter 70.02 RCW, or other applicable healthcare privacy laws.
This information is not intentionally collected through Wix website analytics or Google Analytics and is not intentionally transmitted to those analytics services for analytics or advertising purposes.

4. Sources of Consumer Health Data
Consumer health data covered by this policy may be collected:
Directly from you, such as through your interactions with our public website or information you voluntarily provide through a general inquiry feature.
Automatically through your use of our public website, including through cookies, analytics technologies, server logs, and similar technologies.
From website technology and analytics providers that assist with website hosting, security, performance, and general website analytics.
From referral sources, such as information indicating the website, search engine, or other online source from which a visitor reached our website.
Patient healthcare information entered after you are redirected to a separate patient portal, EHR, or healthcare platform is handled separately as described above.
5. Why We Collect and Use Consumer Health Data
We may collect and use consumer health data covered by this policy to:

These services may process information such as IP address, device and browser information, approximate geographic information, referring source, pages viewed, and general interactions with website content.
Because Summit Mind Psychiatry is a healthcare website, certain website activity could potentially indicate or allow an inference that a visitor is interested in or seeking healthcare services.
When such information constitutes consumer health data under Washington law, we handle it in accordance with applicable privacy requirements.
7. Google Analytics
Summit Mind Psychiatry may use Google Analytics to understand general website traffic, performance, and visitor interactions.
Google Analytics may process information such as:

The public website and the patient EHR/portal environment are intended to remain separate.
8. Links to Patient Portal, Intake, Scheduling, and Healthcare Services
Our website may provide links that redirect you to externally hosted healthcare platforms for functions such as:

Summit Mind Psychiatry does not intentionally transmit information entered into its EHR or patient portal to public website analytics providers.
9. Categories of Consumer Health Data We May Share
Depending on how our public website is used, categories of consumer health data that may be shared or
processed as permitted by applicable law may include:

Consumer health data covered by this policy may be processed or shared, as those terms are defined or applicable under Washington law, with categories of entities that assist us in operating the public website, including:
Website hosting and technology providers — entities providing website hosting, security, maintenance,
and functionality.
Website analytics providers — entities used to understand general website traffic and performance.
Specific services associated with the public website may include:
Wix — website hosting, website functionality, security, and website analytics.
Google Analytics — general website traffic and interaction analytics.
The website may also provide links to independent healthcare or scheduling platforms, including Headway, when applicable. Information entered after you leave our website may be governed by the privacy practices and terms applicable to that healthcare platform and by applicable healthcare privacy laws.
Summit Mind Psychiatry does not currently have corporate affiliates with whom it shares consumer health data.
Our EHR vendor is not listed here solely because it maintains patient healthcare records on our behalf. Patient records maintained within the EHR environment are handled under applicable healthcare privacy laws and our Notice of Privacy Practices.
11. Sale of Consumer Health Data
Summit Mind Psychiatry does not sell consumer health data.
We do not exchange consumer health data for monetary or other consideration in a manner constituting a sale under the Washington My Health My Data Act.
If our practices change in a manner constituting a sale under Washington law, we will comply with applicable authorization and disclosure requirements before engaging in such activity.
12. Advertising
Summit Mind Psychiatry does not intentionally provide consumer health data to third parties for targeted advertising based on an individual's psychiatric diagnosis, medical condition, medication, treatment, or other sensitive health information. We do not intentionally provide PHI, patient medical records, intake responses, or patient portal communications to public website analytics providers for advertising purposes.
13. Your Washington Consumer Health Data Rights
Subject to applicable exceptions and limitations, Washington consumers may have the right to:
Confirm and access consumer health data
You may ask whether Summit Mind Psychiatry is collecting, sharing, or selling consumer health data concerning you and request access to qualifying consumer health data.
Obtain information about sharing
When applicable, you may request information concerning third parties or affiliates with whom your consumer health data has been shared or sold.
Withdraw consent
When collection or sharing is based on your consent, you may withdraw that consent from future collection
Request deletion
You may request deletion of consumer health data concerning you, subject to applicable law.
Appeal a decision
If we decline to act on a qualifying request, you may appeal our decision.
These rights apply to consumer health data governed by the MHMDA. Rights concerning your medical or psychiatric record may instead arise under HIPAA or other Washington healthcare privacy laws and are described in our Notice of Privacy Practices.

You may request access, information about sharing, withdrawal of consent, deletion, or an appeal as applicable.
We may request information reasonably necessary to authenticate your identity and request before providing, deleting, or changing information.
15. Response to Requests
We will respond to authenticated consumer requests within the timeframe required by Washington law.
Generally, we will respond without undue delay and within 45 days of receiving an authenticated request.
When reasonably necessary because of the complexity or number of requests, an additional 45-day period may be permitted by Washington law. If an extension applies, we will notify you within the initial response period and explain the reason.

If Summit Mind Psychiatry declines to act on your consumer health data request, you may appeal the decision by contacting:

Identify the request you are appealing and provide any additional information you would like us to consider.
We will respond within the timeframe required by applicable Washington law.
If an appeal is denied, we will provide information regarding how you may submit a complaint to the Washington State Attorney General when required by law.
17. Consent for Additional Collection, Use, or Sharing
Summit Mind Psychiatry will not collect, use, or share additional categories of consumer health data governed by the MHMDA or use such data for additional purposes not disclosed in this policy without first providing the disclosures and obtaining affirmative consent when required by Washington law.
When Washington law requires separate consent for sharing consumer health data, we will obtain such consent unless the sharing is otherwise permitted without consent.
18. Security
Summit Mind Psychiatry maintains reasonable administrative, technical, and physical safeguards intended to protect consumer health data appropriate to the nature of the information.
Access to consumer health data is limited as appropriate to personnel, contractors, and service providers who require access for authorized purposes.
No electronic system or transmission method can be guaranteed to be completely secure.
Patients should use the designated patient portal or other secure healthcare communication methods for detailed medical, psychiatric, medication, or treatment-related information rather than general public website forms.
19. Children and Minors
Consumer health data concerning minors is handled in accordance with applicable federal and Washington law.
Different privacy, consent, and access requirements may apply depending on the minor's age, nature of the information, circumstances under which healthcare was obtained, and other applicable legal requirements.
Nothing in this policy modifies confidentiality protections applicable to a minor's medical or mental-health records under HIPAA or Washington healthcare law.
20. Relationship to Our Other Privacy Notices
This Consumer Health Data Privacy Policy addresses consumer health data governed by the Washington My Health My Data Act.
It does not replace our:
Privacy Policy, which describes general website privacy practices; or
Notice of Privacy Practices, which describes how Summit Mind Psychiatry uses and discloses PHI and explains patient rights concerning medical and psychiatric records.
Information may be subject to different privacy laws depending on how and where it is collected.
21. Changes to This Policy
We may update this policy to reflect changes in our website, technologies, services, data practices, or applicable law.
When this policy is revised, we will update the “Last Updated” date.
If a change involves additional categories of consumer health data or additional purposes requiring disclosure and affirmative consent under Washington law, we will provide the required disclosure and obtain consent before engaging in that activity.
